Every ingested material that has an effect on hormones, cognition, body chemistry is a drug. Some are legal some are not.
Also the discussion about what is legal is not related to the subject. Law is what a bunch of people say. Theoretically this bunch of people can say that sugar or coffee are illegal too.

You can get deep into the brain chemistry of it but basically the more you have the more you need to get the buzz from it and despite making you feel more 'awake' it is more accurate to say that it delays mental fatigue. I drink energy drinks fairly regularly and every now and again need to quit for a few weeks to reduce my caffeine tolerance. Another interesting note is that caffeine in large-ish amounts will speed up the rate at which your body digests/passes food and this is why caffeine and coffee gives some ppl the shi1ts in the morning.

I think any substance that has an addictive effect can be described as a drug, and there is nothing wrong with that cuz the important thing is its density and quantity.

Technically it's a drug but who cares? It tastes so great, it's probably good for you if you don't have too much, and I can't wake up or get much work done without it.
